Platform Name: QuickDoctory OPD CRM

1. ACCEPTANCE OF TERMS

This Terms of Use Agreement ("Terms", "Agreement") constitutes a legally binding contract between QuickDoctory ("Company", "We", "Us", or "Our"), a healthcare technology startup recognized/operating under the Startup India Initiative, and any individual, clinic, hospital, registered medical practitioner (RMP), administrative staff, or patient ("User", "You", or "Your") accessing or using the website www.quickdoctory.com and the QuickDoctory Outpatient Department Customer Relationship Management platform (collectively, the "Platform" or "Services").

By accessing, registering for, or using the Platform—whether for free, under a trial, or against minimal subscription charges—you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must immediately cease accessing and using the Platform.

2. SCOPE OF SERVICES & PROTOTYPE / BETA DISCLAIMER

2.1. Platform Purpose: QuickDoctory is a SaaS-based OPD CRM designed to streamline clinic workflows, patient queue management, electronic prescriptions, appointment scheduling, billing, and health record organization.

2.2. Early-Stage / Prototype Phase: You acknowledge and agree that QuickDoctory is currently operating in an early-stage deployment/prototype release. While we make reasonable efforts to maintain platform stability and data integrity:

  • The Services are provided on an "AS-IS" and "AS-AVAILABLE" basis.
  • Features, modules, and user interfaces may undergo frequent updates, modifications, or optimizations without prior individual notice.
  • Minimal or nominal fees charged during this prototype phase represent discounted pilot rates and do not constitute a guarantee of permanent fixed pricing for future commercial releases.

3. ELIGIBILITY & USER ROLES

3.1. Healthcare Practitioners & Clinics (Data Fiduciaries / Service Providers):

  • Clinics and Registered Medical Practitioners (RMPs) using QuickDoctory represent and warrant that they possess valid medical licenses, registrations with respective State Medical Councils / National Medical Commission (NMC), and regulatory approvals required to practice medicine in India.
  • Practitioners are solely responsible for verifying patient identities, maintaining accurate clinical notes, issuing valid prescriptions, and complying with the Telemedicine Practice Guidelines, 2020.

3.2. Patients / End Users (Data Principals):

  • Patients accessing OPD services or digital records via QuickDoctory must provide accurate personal information. Minors must be represented by legal guardians.

4. MEDICAL DISCLAIMER — NO MEDICAL PRACTICE OR ADVICE

4.1. Pure Technology Vendor: QuickDoctory is strictly a software technology vendor. QuickDoctory does not practice medicine, render clinical advice, diagnose conditions, prescribe medications, or replace human medical judgment.

4.2. No Doctor-Patient Relationship with Platform: Creation of an account or transmission of data on QuickDoctory does not create a doctor-patient relationship between the User and QuickDoctory. The doctor-patient relationship exists exclusively between the treating Healthcare Practitioner and the Patient.

4.3. Medical Emergency Exclusion: QUICKDOCTORY IS NOT DESIGNED FOR OR INTENDED TO HANDLE MEDICAL EMERGENCIES. In the event of a medical emergency, patients must immediately contact local emergency services (e.g., dialing 108/112 in India) or visit the nearest hospital emergency room.

5. ACCOUNT REGISTRATION, SECURITY & PASSWORDS

5.1. Account Integrity: Users are responsible for maintaining the confidentiality of their login credentials (usernames, passwords, OTPs). Any activity occurring under your registered account is your sole legal responsibility.

5.2. Unauthorized Access: You agree to notify QuickDoctory immediately at support@quickdoctory.com upon discovering any unauthorized access, breach of security, or suspected misuse of your credentials.

6.2. Roles Under DPDP Act 2023:

  • Healthcare Providers/Clinics: Act as Data Fiduciaries responsible for obtaining explicit, informed consent from patients prior to creating digital health profiles or uploading medical records to QuickDoctory.
  • QuickDoctory: Acts as a Data Processor processing health data solely on behalf of and per the instructions of the Healthcare Provider or Data Principal.

6.3. ABDM Alignment: Where applicable, integrations with the Ayushman Bharat Digital Mission (ABDM) and ABHA (Ayushman Bharat Health Account) will follow official National Health Authority (NHA) protocols and consent architecture.

6.4. Data Backup: While QuickDoctory executes automated multi-cloud data backups, Clinics are encouraged to retain local offline copies or summary registers of critical patient files as good clinical practice.

7.1. Introductory / Prototype Pricing: QuickDoctory currently offers access under minimal introductory charges to support pilot adoption under Startup India initiatives.

7.2. Fee Revisions: QuickDoctory reserves the right to modify subscription fees, introduce tier-based pricing, or charge for premium add-on modules upon providing thirty (30) days' advance notice to registered clinics.

7.3. Taxes: All charges are exclusive of applicable Indian taxes (including GST), which shall be payable by the User at the prevailing legal rate.

7.4. Refund Policy: Due to the minimal, discounted nature of prototype software licensing, subscription payments made to QuickDoctory are non-refundable, except where required by law or in cases of duplicate payment processing errors verified by our billing team.

8. INTELLECTUAL PROPERTY RIGHTS

8.1. Company Ownership: All rights, titles, and interests in and to the Platform—including software code, proprietary algorithms, OPD CRM workflows, UI/UX designs, trademarks, logos, and branding—are and remain the exclusive intellectual property of QuickDoctory.

9.2. No Maintenance Liability: QuickDoctory shall not be liable for any operational delays, missed patient appointments, or financial loss resulting from temporary platform downtime during this prototype/pilot operational stage.

10. LIMITATION OF LIABILITY & INDEMNIFICATION

10.1. Limitation of Liability: To the maximum extent permitted by applicable Indian law, QuickDoctory, its founders, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of revenue, clinic profits, patient data loss, or business disruption.

10.2. Maximum Monetary Cap: QuickDoctory's total aggregate liability arising out of or related to these Terms or use of the Services shall not exceed the total amount actually paid by the User to QuickDoctory in the three (3) months preceding the event giving rise to the claim.
